Apostille from India

Apostille certifies a public official’s signature on a document for use overseas. Apostilles are meant to eliminate the need to legalise individual documents while applying for a job, getting married, or engaging in other immigration-related acts overseas. “Removal of the legality criterion for foreign public publications” The Hague Conference on Private International Law (HCCH) 1961 Apostille Convention replaces the time-consuming and expensive legalisation procedure with the issuing of a single Apostille certificate by a Competent Authority in the document’s home country. Over 120 nations, including Australia, France, Germany, India, Japan, the UK, and the US, are currently members. In practise, this process is best handled by embassies and consulates of the destination state in the state of origin.

What is the Hague Convention?

On October 5, 1961, the city of Luxembourg ratified the Hague Convention, also known as the Apostille Convention or Apostille Hague Convention. However, it didn’t become law until January 14, 1965. The agreement was implemented to eliminate the need for legalisation of documents and certifications in order to facilitate easier liberalisation between nations. Once an apostille has been obtained for a document from one of the signatory countries, it can be used in any of the other signatory countries. Trade and other barriers are reduced, and access to services and resources is facilitated between nations.

Procedure

I) There are the following steps in the apostille process for personal documents:

1. Notary Attestation

2. Home Department Attestation or SDM Attestation

3. Apostille from MEA

Attestation by Notary:

Attestation by a notary is one of the most important steps in making sure that educational and personal documents are real. It is done by a lawyer or at the collector’s office at the regional level.

Attestation: Home Department

The next step in getting your document apostilled is for the Home Department, an organisation at the state level that certifies your personal documents, to do it.

Legalizing documents that were made by the same state government is the job of the Home Department. In some states, the Home Department is also called Mantralaya, so Mantralaya Attestation is another name for it.

II) There are the following steps in the process of apostilling an educational document:

Attestation for HRD:

The state’s HRD, or Human Resource Department, is in charge of certifying educational documents. In the given part of authentication, checking the certificate is a big deal. Depending on where the document was made, the university or board that made it needs to check it.

Attestation for SDM:

The Sub-Divisional Magistrate (SDM) can sometimes be used instead of the State attestation. It is done when the attestation from the home department for the HRD attestation is not the best option.

III) There are three steps to getting an apostille for a business document:

Attestation from the Chamber of Commerce:

The Chamber of Commerce (CoC) is a business group and the first step in making sure that your business documents are correct before the MEA is legalised. The state government has nothing to do with business documents.

Attestation from MEA:

The MEA is the part of the central government that is in charge of foreign affairs. It is responsible for giving out stickers and stamps with the MEA logo on them when needed. When both the home country and the country where the passport will be used are members of the Hague convention, it is the last step of legalisation. Please Take Note:

The time frame given in the estimates is an estimate based on what has happened in the past. But there are times when things like natural disasters, government shutdowns, holidays, vacations, etc. can cause delays. We do everything we can to finish the order as quickly as possible. Depending on the type of service, you may need more documents.

How It Works

FAQS

Apostille and attestation aren’t that different from each other, but for some countries that have signed the Hague Convention, an apostille is needed while for the other countries, attestation is done. As proof of apostille, a document is often given a sticker and a stamp. The central government then stamps the documents, which means they can be attested by an embassy.

The MEA is in charge of giving out apostilles, and the process has been split between 16 cities. But MEA doesn’t take applications from private people. Because the process takes so long, the government can’t be reached right away. Expert services can help you apply for document apostille authentication and make sure the process is done right. LegalDocs has been a service provider for more than four years, and in that time it has offered reliable services for authenticating all kinds of documents. Just put in an application request online and wait for the executive to call.

Apostilles can be made by countries that have signed the 1961 Hague Convention. In many countries, it is often put out by the state secretariat. In countries like India, documents can be apostilled by the Ministry of External Affairs (MEA), which is sometimes called the Ministry of Foreign Affairs (MOFA). Before getting a sticker from the MEA, you still have to go through a few more steps of certification and verification. One of them is the notary. Another is the state.
In India, the Ministry of External Affairs (MEA), which is part of the central government, is in charge of apostilling documents. In 2019, the branch secretariats and RPOs are in 15 cities: Ahmedabad, Bengaluru, Bhopal, Chennai, Chandigarh, Cochin, New Delhi, Guwahati, Hyderabad, Kolkata, Lucknow, Mumbai, Panaji, Raipur, and Thiruvananthapuram. Before getting the same, you must get verification from the state government.
No, a notary cannot put an apostille on a document; only the MEA, which is part of the central government, can do that. Personal and school documents that need to be legalised need to be checked by a notary in order to get a stamp of approval from the state and an apostille from the MEA. Commercial documents do not need to be attested by a chamber of commerce.
